Boardwalk 1000, LLC (“Boardwalk”, “we”, “us”, or “our”) value your privacy. This Privacy Policy explains how we collect, use, protect, and disclose personally identifiable information and data (“Personal Information”) when you use the website at casino.hardrock.com/atlantic-city (the “Site”) and associated applications and services, including any online reservations you make at the Hard Rock Hotel & Casino Atlantic City (collectively, the “Services”). This Privacy Policy also explains your choices for managing your information preferences, including opting out of certain uses of your Personal Information. This Privacy Policy is subject to the Terms and Conditions that govern this Site and the Services. By accessing or using the Site or the Services, you consent to and agree to be bound by such Terms and Conditions and this Privacy Policy.
1. WHO IS COLLECTING YOUR INFORMATION
The Site is owned and operated by Boardwalk. Personal Information collected through the Site may be shared with our owners, licensors, and affiliated entities, including, but not limited to, Hard Rock Cafe International (USA), Inc. and its affiliated entities (collectively, “Hard Rock”). This Privacy Policy applies only to the Site and not to the third-party booking engine described below. Boardwalk is the sole owner of the information collected on the Site, except that it may jointly own the Reservation Information (as defined below).
2. MANAGING YOUR INFORMATION PREFERENCES/ACCESS AND CORRECTION
You can ask us to review, correct, update, change, or delete your Personal Information (defined below) and also opt out of receiving e-mails containing promotional material by reaching out to us as described in the Section 14 “How to contact us” of this Privacy Policy. You may also opt of receiving e-mails from us containing promotional material by clicking on the unsubscribe button at the bottom of such e-mails.

Personal Information We Collect Directly From You
We collect Personal Information, such as your name, address, telephone number, e-mail, and other personally identifiable information that you choose to provide us, such as when you register for e-mail communications or our rewards program or book a room at our hotel through our Site. For more information on what information we may collect in connection with reservations, please see the Reservation System section below. For more information on what information we collect in connection with our rewards program, please see the Rewards Program section below.
By providing us with your email address, you consent to receiving emails from us. You may revoke this consent at any time as described in the section on “Managing Your Information Preferences”.
We may also collect Personal Information, such as first and last names, addresses, e-mail address(es), telephone numbers, marital status, family information, and types of business information: (a) in connection with requests for proposals for weddings, meetings and other special events by completing forms on the Site; and (b) when you request certain services offered at our casino and hotel. When we collect this type of information, we will notify you as to why we are asking for information and how this information will be used. Providing this information is optional; provided, however, if you choose not to provide the requested information, you may not be able to use some or all of the features of the Site or the Services.
From time to time, our Site may request information from you via surveys, sweepstakes, or contests. Participation in these surveys, sweepstakes, or contests is completely voluntary. Requested data may include your contact data, data of birth, marital status, number of children and their ages, and your opinion/answers, social network and ‘handle’ data, preference information, and your survey answers/opinions. Contact information will be used to administer your participation in a contest or sweepstakes, notify the winners, and award prizes. Survey information will be collected and used for purposes of monitoring or improving the use and satisfaction of the Site and our other products and services.
Information We Collect Automatically
We may automatically collect the following information about your use of our Site or Services through cookies and other technologies: your domain name; your browser type and operating system; web pages you view; links you click; your IP address; your mobile device ID; the length of time you visit our Site or use the Services; and the referring URL, or the webpage that led you to our Site (collectively, the “Usage Data”). Reservation System
When you make a reservation online, you will be asked to supply your name, e-mail address, birthdate, telephone number, and employer or company name, and credit card, debit card or other form of payment information (collectively, the “Reservation Information”). This Reservation Information is collected and processed by the following online booking engine (the “Booking Engine"): Synxis CRS offered by Sabre Hospitality Solutions. The Booking Engine is subject to change and any such change will be reflected in an updated version of this Privacy Policy.
The Booking Engine will provide the Reservation Information to us to complete your reservation and to provide you with services. Some of the Reservation Information may also be provided to Boardwalk to verify if a visit occurred and to Boardwalk and Hard Rock for purposes of tracking loyalty rewards under their respective rewards program.
The Booking Engine is contracted to collect and provide the Reservation Information to us for purposes of making and managing your reservations at our hotel. However, the Booking Engine is separately owned and operated from Boardwalk, and therefore, this Privacy Policy does not pertain to the policies and practices of such Booking Engine. Please consult the privacy policies of the Booking Engine at https://www.sabre.com/about/privacy-policy/ regarding their policies and practices with respect to the Personal Information they collect and process in providing these reservation services.

PLEASE NOTE THAT BOARDWALK AND HARD ROCK DISCLAIM ANY AND ALL RESPONSIBILITY OR LIABILITY RELATING TO USE OF YOUR PERSONAL INFORMATION (INCLUDING RESERVATION INFORMATION) BY THE BOOKING ENGINE.
Rewards Program
We may collect information from you with respect to any rewards or loyalty program we may provide to our customers (the “Rewards Program”), including name, address, e-mail address, telephone number(s), and information relating to any transactions and expenditures with our hotel and casino (the “Transaction Information”). You agree that we may use the information we collect, including the Transaction Information, for purposes of administering the Reward Programs and for the other purposes specified in this Privacy Policy.
4. RIGHT NOT TO PROVIDE INFORMATION
In certain jurisdictions, you may have the right not to provide Personal Information. However, if you elect not to provide such information, you may not be able to utilize certain Services, including making room and other reservations online.
5. HOW WE USE YOUR INFORMATION
We use your information, including your Personal Information, for the following purposes:
To provide our Site and the Services to you, to communicate with you about your use of our Site and the Services, to respond to your inquiries, to fulfill your orders, and for other customer-service purposes.
To tailor the content and information that we may send or display to you, to offer location customization, and personalized help and instructions, and to otherwise personalize your experiences while using our Site or the Services.
For marketing and promotional purposes. For example, we and Hard Rock use your information, such as your e-mail address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information we think may interest you. We also may use the information that we learn about you to assist us in advertising our Site, and related services on third-party websites.
To conduct promotions, such as sweepstakes, contests, and giveaways, and to administer and operate our Rewards Program.
To better understand how users access and use our Site and the Services, both on an aggregated and individualized basis, in order to improve our Site and the Services and respond to user desires and preferences, and for other research and analytical purposes.
6. HOW WE SHARE YOUR INFORMATION
We may share your information, including Personal Information, as follows:
Affiliates. We may disclose the information we collect from you to our affiliates and to Hard Rock and its affiliates; provided, however, if we do so, their use and disclosure of your personally identifiable information will be maintained by such affiliates in accordance with this Policy. Personal Information is also shared with the Booking Engine in order to process your reservations and provide you with services.
Service Providers. We may disclose Personal Information we collect from you to third-party vendors, service providers, contractors or agents who perform functions on our behalf (“Service Providers”). For example, we may contract with Service Providers to provide certain services, such as hosting and maintenance, data storage and management, and marketing and promotions. We only provide our Service Providers with the information or access to information necessary for them to perform these services on our behalf. Each Service Provider must agree to use commercially reasonable security procedures and practices, appropriate to the nature of the information involved, in order to protect your Personal Information from unauthorized acquisition, access, use, or disclosure. Service Providers are prohibited from using Personal Information other than as authorized by Boardwalk.
Business Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company or legal entity.
Other Disclosures: We may disclose your Personal Information to third parties if necessary or appropriate: (a) to comply with Applicable Laws, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including authorities outside your country of residence and to meet national security or law enforcement requirements; (d) to protect our operations, such as in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock; (f) to protect the rights, privacy, safety or property of the Hard Rock Affiliated Parties, you or others; (g) to protect any tangible or intangible property of the Hard Rock Affiliated Parties; (h) to allow us to pursue available remedies to protect our interests or those of our Members; and (i) to prevent or limit any damages that we may otherwise sustain.
Aggregate and De-Identified Information. We may share aggregate or de-identified information about users, such as Usage Data, with third parties and publicly for marketing, advertising, research or similar purposes.
Except as noted in this Section 6, we do not disclose Personal Information to third parties, including for their direct marketing purposes, without your consent, except as explained in this Privacy Policy. We may disclose certain Usage Data regarding the Site and Services to third parties. However, in such cases, your Usage Data does not identify you individually.
7. OUR USE OF COOKIES AND OTHER TRACKING MECHANISMS
We and our Service Providers use cookies, web beacons and other tracking mechanisms to track information about your use of our Site and the Services. We may combine this information with other Personal Information we collect from you (and our Service Providers may do so on our behalf).

11. CHILDREN’S PRIVACY
The Site and Services are intended for users who are twenty-one (21) years old or older. In addition, we never collect or maintain information at our Site from those we actually know are under the age of thirteen (13). If we are notified that we have collected Personal Information from a person under the age of thirteen (13), we will delete that information. Our Site is a general audience website.
12. PROCESSING IN THE UNITED STATES

13. EU-U.S. DATA PRIVACY FRAMEWORK (DPF) AND THE UK EXTENSION OF THE EU-U.S. DPF COMPLIANCE
Boardwalk participates in and complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), and the UK Extension of the EU-US DPF as approved by the European Commission in its adequacy decision issued on July 10, 2023.
Boardwalk complies with the EU-U.S. Data Privacy Framework and the UK Extension of the EU-U.S. DPF Principles, that were developed by the U.S. Department of Commerce in consultation with the European Commission in order to provide organizations in the United States with a reliable mechanism for personal data transfers to the United States from the EU while ensuring that EU data subjects and the UK data subjects continue to benefit from effective safeguards and protection as required by European legislation with respect to the processing of their personal data when they have been transferred to non-EU countries.
If there is any conflict between the policies in this privacy policy and the EU-U.S. DPF and the UK Extension of the EU-U.S. DPF Principles, the EU-U.S DPF and the UK Extension of the EU-US DPF Principles shall govern.

This dispute mechanism will cover all Personal Information except for human resource data. Under certain limited conditions and as a last resort, the individual can invoke binding arbitration. The Federal Trade Commission has jurisdiction over Boardwalk’s compliance with the EU-U.S. DPF and the UK Extension of the EU-U.S. DPF.
If Boardwalk transfers your Personal Information to a third party, we will ensure the third party is contractually obligated to process your data only for limited, specific purposes consistent with this policy, to apply the same level of protection to that data as the EU-U.S. DPF and the UK Extension of the EU-U.S. DPF Principles, and notify us if it makes a determination that it can no longer meet this obligation. Upon notice, Baordwalk will take reasonable and appropriate steps to stop and remediate unauthorized processing. In cases of onward transfer to third parties of Personal Information received pursuant to the EU-U.S. DPF and the UK Extension of the EU-U.S. DPF, Boardwalk is potentially liable.
